1Acceptance of Terms

These Terms of Use ("Terms") form a legal agreement between you and ResMac, Inc. ("ResMac," "we," "us," or "our"). By accessing or using our website (including resmac.com and apply.resmac.com), submitting an application, or otherwise interacting with our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use our website or services.

2Eligibility

You must be at least 18 years old and a legal resident of the United States to use our services. By using our site, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.

ResMac is currently licensed to originate mortgage loans in the following states: Arizona, Arkansas, California, Colorado, Georgia, Minnesota, Missouri, New Jersey, Oklahoma, Oregon, Rhode Island, Tennessee, and Texas. We cannot accept loan applications for property located outside these states.

3Nature of Services

ResMac is a licensed residential mortgage lender (NMLS# 153098). Through our website, you can:

  • Submit a pre-qualification request
  • Complete a Uniform Residential Loan Application (URLA / Form 1003)
  • Schedule consultations with our loan officers
  • Receive marketing communications about our products and services

Our website provides informational and application services. Loan approval, terms, and final pricing are determined through our underwriting process and require additional documentation, verification, and an executed loan agreement.

4Not a Loan Commitment or Lock

Important Disclosure Submitting a pre-qualification or application through our website does NOT constitute a loan approval, loan commitment, or rate lock. Pre-qualifications are based on information you provide and are not guaranteed.

All loans are subject to:

  • Credit approval
  • Underwriting review
  • Property appraisal
  • Title and lien clearance
  • Investor and program-specific guidelines
  • Compliance with all applicable federal, state, and investor requirements

Interest rates, fees, and program availability change daily and vary based on borrower qualifications, property type, loan amount, occupancy, and other factors. Any rate quote or estimate is informational only until a formal Loan Estimate is delivered and a rate is locked in writing.

5User Submissions & Accuracy

You agree to provide truthful, accurate, current, and complete information when submitting forms or applications. Knowingly providing false information on a mortgage application is a federal crime under 18 U.S.C. § 1001 punishable by fine and/or imprisonment.

You authorize ResMac to verify any information you provide, including ordering credit reports, employment and income verification, and asset verification.

You are responsible for maintaining the confidentiality of any login credentials we may issue to you.

6Acceptable Use

You agree not to:

  • Use our site for any unlawful purpose or in violation of these Terms
  • Submit fraudulent, misleading, or false information
  • Impersonate any person or entity
  • Interfere with or disrupt the site, servers, or networks
  • Attempt to access accounts, systems, or data not authorized to you
  • Use automated tools (bots, scrapers, crawlers) without our written permission
  • Reverse-engineer, decompile, or attempt to derive source code
  • Transmit viruses, malware, or other harmful code
  • Engage in any activity that could damage, disable, or impair the site

We reserve the right to suspend or terminate access for users who violate these provisions.

7Electronic Communications & E-SIGN Consent

By using our website and providing your contact information, you consent to receive communications from ResMac electronically (including email, SMS/text, and via our website) for matters related to your application, account, and our services.

Pursuant to the Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), 15 U.S.C. § 7001, you agree that electronic signatures, contracts, and other records satisfy any legal requirement that such communications be in writing. You may withdraw your consent to receive electronic disclosures by contacting info@resmac.com; doing so may affect your ability to apply for or receive services online.

Standard message and data rates may apply to SMS messages. Reply STOP to opt out of marketing SMS at any time.

8Intellectual Property

All content on our website — including text, graphics, logos, images, software, and the "ResMac" name and logo — is the property of ResMac or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, revocable license to access and use the website for personal, non-commercial purposes related to using our services. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission.

Any feedback, suggestions, or ideas you submit may be used by ResMac without compensation or obligation.

9Third-Party Services

Our website integrates with third-party services such as Cal.com (scheduling), Google Analytics (analytics), Google Ads, and Meta (advertising). These services are provided by independent companies and governed by their own terms and privacy policies. ResMac is not responsible for the content, practices, or availability of third-party services.

10Disclaimers

THE WEBSITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION, INCLUDING RATE QUOTES, PAYMENT ESTIMATES, OR PRE-QUALIFICATION RESULTS.

Information on our website is for general informational purposes and does not constitute legal, financial, tax, or investment advice. You should consult appropriate professionals for advice specific to your situation.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RESMAC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT OF FEES YOU PAID TO RESMAC IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such exclusions or limitations are not permitted, our liability will be limited to the maximum extent allowed by law.

12Indemnification

You agree to indemnify, defend, and hold harmless ResMac and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the website or services
  • Your breach of these Terms
  • Your violation of applicable law or any rights of a third party
  • Any false, misleading, or fraudulent information you provide

13Dispute Resolution & Arbitration

⚠️ PLEASE READ CAREFULLY: This section requires individual arbitration of disputes and waives the right to a jury trial and class action.

Informal Resolution

Before filing any formal dispute, you agree to first contact us at info@resmac.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our website (excluding claims for injunctive relief or intellectual property) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • The arbitration will be conducted in Palm Beach County, Florida or such other location as required by applicable consumer protection law
  • The arbitrator's decision is final and binding
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction

Class Action Waiver

YOU AND RESMAC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND RESMAC AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

Opt-Out Right

You may opt out of this arbitration provision by sending written notice to info@resmac.com within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Exception for Loan Documents

If you sign a loan agreement with ResMac, the dispute resolution provisions in your loan documents (which may differ from this section) will govern disputes related to your loan.

Note for compliance review: The arbitration clause may need to be revised or removed depending on (1) loan type (CFPB regulations restrict mandatory arbitration in certain mortgage loan agreements but generally permit pre-loan website terms) and (2) state law in certain states. Your compliance officer or legal counsel should review.

14Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Subject to the arbitration provisions above, any legal action shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

Federal law applicable to mortgage transactions, including but not limited to the Truth in Lending Act, Real Estate Settlement Procedures Act, Equal Credit Opportunity Act, Fair Credit Reporting Act, Fair Housing Act, and Gramm-Leach-Bliley Act, also applies.

15Changes to These Terms

We may modify these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. Material changes will be brought to your attention via email or a prominent notice on our site. Your continued use of the website after changes take effect constitutes acceptance of the updated Terms.
